The Florida Department of Highway Safety and Motor Vehicles outlines the required insurance coverage as follows:

• Property Damage Liability coverage of at least $10,000

According to Allstate, Florida is one of the many states where electronic proof of insurance is accepted. That means you can present your insurance card on your phone or another device rather than carrying a paper copy.

You can also satisfy Florida’s financial responsibility law by self-insuring.

In order to self-insure, you will need to provide proof that you have a net worth of at least $40,000 in freely available assets and can be financially responsible for damages in an at-fault accident.

If you meet the requirements, the state will issue a certificate of self-insurance providing $10,000 in bodily injury liability per person, $20,00o for two or more people, and $10,000 in property damage.

Car Insurance Laws

Let’s start with a look at legislation regarding car insurance in Florida.

How State Laws for Insurance Are Determined

While the Florida State Department is in charge of elections and the state’s constitution, Florida’s insurance laws are determined by the State Legislature. They are set out in Title XXXVII, Chapter 624-651 of the state statutes. Motor vehicle laws can be found in Title XXIII, Chapters 316-324.

According to the NAIC, in Florida rating filing is done with a file and use system, but if the rate increase is found excessive the company will be required to return excess premium. Form filings require 30-day advance approval.

In 2019 a bill to repeal Florida’s PIP law was introduced, but it failed to pass.

Windshield Laws

Under Florida law, all windshield replacement parts must be of equal quality, fit, and performance.

The law also requires that insurance companies waive the comprehensive deductible for windshield repair, according to CarWindshields.info.

High-Risk Insurance

There are several ways a driver can come to be considered high risk. The most common are DUI convictions, violation of the financial responsibility law, or having multiple tickets and accidents.

In these cases, the driver may be required to file either an SR-22 or an FR-44 to prove they are in compliance with financial responsibility laws. Unfortunately, insurance for high-risk drivers can be hard to find and expensive.

The Florida Automobile Joint Underwriting Association (FAJUA) helps high-risk drivers to obtain coverage when they have been unable to do so on the open market.

All insurance companies licensed in Florida must be a part of the association. Drivers are assigned to a company, and that company is required to offer a policy.

This isn’t cheap high-risk insurance. It’s a last resort for those that can’t get coverage elsewhere.

A lot of other companies write high-risk policies, and there are still options to shop around for insurance. Drivers will only wind up in the high-risk state pool if those companies have turned them down.

Automobile Insurance Fraud in Florida

Insurance fraud is a crime in Florida, and the no-fault system has made fraud a serious issue. According to the Insurance Information Institute, fraud accounts for about 10 percent of the insurance industry’s losses.

In 2012, the Florida legislature passed HB 119, which places restrictions on PIP claims in order to reduce fraud. The bill required all that the injured person see a doctor within 14 days of the incident.

The state has some of the heaviest fraud laws around, including mandated reporting by insurance companies (with immunity offered to whistle-blowers) and mandatory auto photo inspections.

The Florida Department of Financial Services Bureau of Insurance Fraud is in charge of investigating cases of suspected fraud.

Fraud can be reported to the department by calling 1-800-378-0445.

You can also report fraud online.

If you’re convicted of insurance fraud in Florida, the consequences can be serious. Insurance fraud is usually prosecuted as a felony offense.

In addition to these penalties, convictions can include paying compensatory damages, court and lawyer fees, and civil penalties.

Statute of Limitations

The Florida Statue of Limitations on insurance claims is four years for both property damage and personal injury.

As mentioned above, however, you must visit a doctor or other provider within 14 days of an accident occurring to use PIP coverage.

State Specific Laws

Here’s an only-in-Florida law worth a mention: your swamp buggy isn’t considered a motor vehicle. That means you’ll have to keep it off the roads and in the swamps.

The Florida legislature changed the definition of motor vehicles in 2013 with the express purpose of keeping swamp buggies off public roads.

Vehicle Licensing Laws

With insurance laws covered, we’ll now take a look at the laws that govern vehicle and driver licensing in Florida

REAL ID Law

As of October 1, 2020, federal law will require everyone boarding a domestic flight to present a specific type of identification – and a regular driver’s license will no longer fit that description. The Department of Homeland Security outlines the REAL ID laws and which states are compliant.

Every state has been required to offer a REAL ID-compliant driver’s license that can be used for that purpose. If you don’t have a REAL ID, you can still fly using another form of acceptable ID, including a passport.

Florida is REAL ID compliant, and you can obtain yours at a Florida Highway Safety and Motor Vehicles office.

REAL ID requires a more stringent proof of identity than a standard license.

U.S. Citizens will need to bring one of the following:

• Valid, unexpired U.S. passport
• Original or Certified copy of a birth certificate
• Consular Report of Birth Abroad
• Certificate of Naturalization issued by DHS
• Certificate of Citizenship

For cases where the current name and the name on the primary identity document are different, you should also bring:

• Court-ordered name change document
• Marriage certificate, issued by the courts and/or
• Divorce decree, issued by the courts

Non-Citizens will need:

• Valid, unexpired Permanent Resident Card – I-551 for Lawful Permanent Residents
• Valid Passport for non-immigrants except for asylum applicants and refugees
• Other government-issued document showing your full name
• Department of Homeland Security document showing proof of lawful presence
• If your name has changed by marriage/divorce, you must have your name changed on your Citizen and Immigration Services (CIS) documents.

No matter your status, you will also need your social security card and two documents showing your principal residence address.

Penalties for Driving Without Insurance

In Florida, it’s illegal to drive without insurance. If you’re caught, the following penalties will apply:

• For a first offense, your license and registration will be suspended until you pay a $150 reinstatement fee and secure non-cancelable (SR-22) coverage.
• For a second offense the reinstatement fee increases to $250, and the other penalties remain the same.

Florida doesn’t yet have an auto insurance database that allows law enforcement to verify coverage on the spot, but the legislature is looking at instituting one. A bill was filed in January of 2019 but withdrawn shortly thereafter.

Florida allows proof of insurance to be presented in both paper and in electronic form.

Teen Driver Laws

According to the Insurance Institute for Highway Safety (IIHS), Florida’s Graduated Driver Licensing (GDL) program for teens starts at age 15.

It’s a three-stage program that eases teens into the responsibilities of driving while allowing them to improve their skills.

A U.S. Department of Transportation study showed a 20 percent reduction in fatal crashes among 16-year-old drivers as a result of GDL programs.

Florida’s GDL operates in these three stages, according to the Florida Highway Safety and Motor Vehicles website.

Older Driver Renewal Procedures

Florida has special rules for drivers aged 80 and over renewing a driver’s license.

After age 80, drivers must renew every six years and are required to provide proof of adequate vision at every renewal.

New Residents

Welcome to Florida – you need a new license within 30 days.

New residents will need to bring their existing driver license to an FHSMV office and surrender it in return for a new Florida license. You’ll need to bring an extra piece of identification.

There’s no test required for those with a clean record, but if you have problems on your record you’ll need to pass a written test. All applicants will need to pass a vision test as well.

License Renewal Procedures

Florida driver licenses need to be renewed every eight years. You can renew either by mail or online every other renewal.

Drivers will need to have their vision checked at every in-person renewal.

Negligent Operator Treatment System

Florida uses a points system to track driver violations. Each violation has a points value, and they add up over time.

Running a red light or speeding, for example, are three points. Failing to stop for a school bus with red lights flashing is four points.

If you accumulate too many points, your license will be suspended as follows:

• 12 points accumulated within 12 months: 30-day suspension
• 18 points accumulated within 18 months (including points from a 12 point suspension): 3-month suspension
• 24 points accumulated within 36 months (including points from a 12 point and/or 18 point suspension): one-year suspension

Rules of the Road

Now we will take a look at some of the most important rules of the road to know when driving in Florida.

Fault Vs. No-Fault

As we have already discussed, Florida has a somewhat controversial no-fault insurance system.

If you are in an accident, your PIP coverage will pay for your medical bills regardless of who is at fault.

Fault will still be determined, and you can still be held responsible for damages, including property damage and excess medical under the right circumstances.

According to

. you can sue after a car accident when the following injuries occur:

• significant disfigurement
• bone fracture
• permanent limitation of use of a body organ or member
• significant limitation of use of a body function or system, or
• substantially full disability for 90 days.

Seat Belt and Car Seat Laws

Florida law requires everyone in the vehicle to use an appropriate restraint.

For drivers as well as passengers aged six years and older, seat belts must be used in the front seat. The law only applies in the front seat for passengers 18 and older.

For passengers under the age of six, car seat laws apply. All children must ride in a car seat appropriate to their size and weight. It’s worth noting that these laws are a little behind the current American Academy of Pediatrics car seat recommendations.

Seat belt laws carry a $30 fine, while car seat laws double that fine to $60.

Florida law also prohibits anyone under 18 from riding in an open cargo area. Additional rules apply to enclosed cargo areas, which can be used for riding if on specific types of roads. That usually includes non-public access roads. If seatbelts have been fitted in the cargo area, the rules don’t apply.

Keep Right and Move Over Laws

You will need to yield to traffic behind you and move to the right lane if you are moving slower than the rate of other traffic and are holding up vehicles behind you.

In other words, keep right unless you are passing, and allow drivers who want to pass you to do so by moving to the right lane.

According to AAA, Florida law also requires you to slow down to 20 mph below the posted limit and move over into the left lane if safe to do so when passed a stopped emergency vehicle.

Speed Limits

The speed limit in Florida is 70 mph on rural freeways and other limited-access roads. It’s reduced to 65 mph on urban freeways and other roads.

As always, obey the posted speed limit. It can change in construction zones and other areas.

Ridesharing Laws

Drivers for Uber and Lyft should obtain rideshare insurance in Florida. It’s sold by several insurance companies as an endorsement to your personal insurance policy that fills the gaps between your own insurance and that provided by the rideshare company.

Minimum insurance requirements are different in Florida for a rideshare driver. As soon as the app is turned on you need:

• $50,000 in bodily injury coverage per person and $100,000 per incident
• $25,000 in property damage coverage

Currently, Farmers, State Farm, Mercury, and Bristol West all offer rideshare endorsements in Florida.

Automation On The Road

As of July 1, 2019, new autonomous vehicle laws went into effect in Florida.

Autonomous vehicles can legally be on all public roads without a human operator. $1 million in liability coverage is required for these vehicles.

Safety Laws

Driving under the influence of alcohol is illegal in Florida and carries some hefty penalties. According to Responsibility.org, there were nearly 33,000 DUI arrests in Florida in 2017.

Florida has no specific marijuana-impaired driving laws or legal limit.

As with the use of all drugs, law enforcement can exercise judgment as to the impairment of a driver and charge anyone who appears to be impaired with a DUI. The same penalties will apply if convicted.

Distracted Driving Laws

It is illegal in Florida to text while driving. Texting while driving is now a primary offense, which means officers can ticket drivers who text in their vehicles.

As of October 1, 2019, it will also be illegal to use a handheld cell phone in school and work zones. All other use continues to be permitted.
