Finally, because the prices are so gouged, there is an unusually high number of uninsured motorists on the road. According to III, 20.3 percent of drivers in Michigan are uninsured.

Michigan Minimum Coverage

- $20,000 per person hurt or killed in an accident

Also, residents must have residual liability insurance to protect from the limited situations in which the no-fault system does not apply. These situations include accidents causing death or serious injuries, out-of-state accidents, or accidents involving damage to a resident of another state.
Forms of Financial Responsibility
Financial responsibility rules and regulations refer to drivers being required to show some sort of proof of insurance. When this becomes tricky is when drivers are found uninsured. To avoid the uninsured driver from receiving no justice, different laws require them to be responsible for some if not all expenses.
With the no-fault coverage being required and the prices of insurance being so high, Michigan is notorious for its uninsured motorists.

In this section, we’ll review the important state laws of Michigan and also some of the foremost car insurance laws.
Car Insurance Laws
Let’s start by taking a look at the laws that directly affect car insurance. (For more information, read our “Michigan Car Insurance Laws“).
New Insurance Reform Law
On May 25, 2019, the Legislature passed a new Michigan No-Fault law. This new law changes auto no-fault insurance laws. Governor Whitmer signed these wild changes into law only a few days later.
The law has now undergone substantial changes that will affect every driver in Michigan.
The main change behind the law is that drivers after July 2020 will have the option to purchase personal injury protection instead of being required to have it.
This became a topic in the political game when there was an enormous outcry against the expensive auto insurance in the state.
Governor Whitmer and the legislature took notice and did something right by the drivers in Michigan. This new law should save people hundreds and even thousands of dollars a year.
How State Laws for Car Insurance Are Determined
Like most states, car insurance laws are determined by the legislature.
According to the NAIC, in Michigan rating filing is done with a file and use system, but if the rate increase is found excessive, the company will be required to return excess premium. Form filings require 30-day advance approval.
Windshield Coverage
Windshields are a pain. Chips and cracks are something you cannot avoid when driving on the road. Especially if you have a long commute, it happens to everyone. But for some reason, every state has weird laws about windshields.
In Michigan, insurance companies restrict which companies can repair your windshield. If you have a company repair your windshield and that company isn’t one used by your insurance, they will fight you not to cover it.
High-Risk Insurance
High-risk insurance covers the individual drivers with past driving violations, inexperience behind the wheel, or poor credit.
Any of these could have you paying a lot more for car insurance than the average person with a clean record. Some companies won’t insure a high-risk driver at all, but most large companies will take a risk and just overcharge.

The only states that have government-funded programs are California, Hawaii, and New Jersey. These programs are built to help low-income families be able to protect themselves while they drive.

Some other common fraud acts are misrepresenting facts on an insurance application, submitting claims for injuries or damage that never occurred, services never rendered or equipment never delivered, and staging accidents.
Insurance fraud is against the law in every state. In Michigan, insurance fraud is a felony, punishable by up to four years in jail and up to $50,000 in fines. There’s also restitution, court costs, and lawyer’s fees to pay.

For example, if a driver gets in an accident and five years later decides they were hurt in that accident; the statute of limitations prohibits that person from pursuing legal action because it’s been too long since the date of the crash.

As in most states, vehicle licensing laws are handled in Michigan by the DMV. There are a lot of different rules and regulation to know about, but these are the most important ones to keep in mind. Knowing these could help you out in your shopping for insurance.
Real ID
According to Homeland Security, The Real ID Act establishes security standards for license issuance and production. This prohibits Federal agencies from accepting driver’s licenses and ID cards from states not meeting the Act’s minimum standards.

Penalties for Driving Without Insurance
The penalties for driving without insurance in Michigan are as follows: $200 to $500 fine and/or imprisonment for one year or less; (depending on severity); license suspension for 30 days or until proof of insurance; $25 service fee to Secretary of State. The judgment is usually up to the police officer or the legislature later on in court.
Michigan allows different types of proof of insurance, which include the original paper copy and electronic evidence as well. As long as your proof of insurance displays the following things, it is usually accepted:
- Make
- Model
- Year
- Safety Rating
- Value
- Your name and the name of any other drivers under that policy
- Expiration date
As long as you have this, you will never run into any issues.
Teen Driver Laws
Teens are inexperienced drivers and have to learn as they go on the road. Some are reckless and speed everywhere, while others are too scared to get behind the wheel at all.
Michigan, like most states, eases teens into the process of driving alone. First, when they are 16 they must have a driving permit for a year, then when they turn 17 must drive with a parent at night for six months, then finally no restrictions except for some minor passenger laws.
This has been proven to help causes a little, but teens are still the highest risk drivers on the road. This is why their car insurance is so much higher than any other age.
Older Driver License Renewal Procedures
Older drivers can be very dangerous. It is a heavily debated topic as to how often older people must renew their licenses and how long they should be able to drive in general.
Each state has general laws that state how long between renewals you have, and vision test requirements.
In Michigan, licenses are renewed every four years. Vision must be tested every time you renew in person and must be renewed every other year in person.
Many believe this not to be strict enough for the elderly.

As mentioned previously, Michigan is a no-fault state. Meaning, when it comes to an accident no matter who is at fault insurance provides personal injury protection with no maximum limit for any injuries that occur.
Instead of whoever is at fault paying for everything; drivers have insurance to cover their own injuries and damage rather than the other person doing everything.
At-fault insurance means a driver is responsible for damages in an accident where they are found at fault.
Seat Belts and Car Seat Laws
Seat belts are an important part of road safety. They save countless lives every day. In Michigan, it is required for the driver and all front-seat passengers age 16 and older to wear a seat belt.
Violation of the seat belt law is a basic offense which usually results in a warning or a citation.
According to AAA, Riding in the cargo area of a pickup truck is not permitted for persons under age 18 unless the vehicle is moving under 16 mph.
Keep Right And Move Over Laws
The keep right law states that slower traffic must keep right in all instances. This is not only for safety for all drivers but also to keep the flow of traffic moving and limit commutes.
The move over law states that if you are in the left lane and a car comes up behind you going faster than you are, that you must switch lanes. Just like the keep right law, this keeps traffic moving at a much faster pace.
In most states, if an official finds you disobeying these laws it can result in up to a $200 ticket.
Speed Limits
In Michigan, on every highway (urban or rural) the speed limit is 70 for cars and 65 for semi-trucks. On regular roads, the speed limit is 55 unless otherwise posted.
In residential neighborhoods, like most of the neighborhoods in the U.S., the speed limit is 30.
Ridesharing
There are not many laws against ridesharing unless there is a carpool lane which will be marked by a diamond.
Uber and Lyft are becoming very popular; the only thing to worry about with those is to assure the driver is properly insured.
